§ 00

Welcome to ampd.

ampd is a professional platform for the creator economy. We bring creators, brands and agencies into one place to discover each other, message, collaborate on campaigns, and process payments — all in one workflow.

These Terms of Service ("Terms") govern your use of ampd, including the website at ampd.world, the ampd mobile and web applications, and any related services we provide (together, the "Services"). The Services are operated by Xilligence ("ampd," "we," "us," or "our").

By creating an ampd account or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

These Terms form a legally binding agreement between you and Xilligence. Please read them carefully.

§ 01

The services we provide

Our mission is to give creators, brands and agencies one place to do creator marketing — properly. To advance this mission, we provide you with the products and services described below.

Helping you discover the right partners

ampd connects creators with the brands that fit their work, and brands with the creators their audience will trust. We use information you provide (your profile, content niche, audience data) and information from connected social platforms to suggest matches, surface relevant opportunities, and personalise your experience on the Services.

Empowering you to collaborate

We provide tools to help you do the work of creator marketing — sending briefs, sharing drafts, reviewing and approving content, tracking timelines, and managing assets. The Services are designed so the whole campaign lives in one place.

Enabling payments between users

For campaigns run on ampd, we facilitate payments between brands or agencies and creators using regulated payment partners. We may hold funds in escrow until both parties confirm campaign delivery, and we release funds in line with the terms of each campaign.

Showing you relevant content and opportunities

We use information about you, your role, your activity and your preferences to surface creators, brands, campaigns and content that may be relevant to you on the Services. We do not show third-party advertising on ampd.

Protecting the safety, security and integrity of the platform

People only build professional relationships on ampd when they trust the platform. We work to detect and prevent fraud, abuse, harassment, spam, fake accounts, and other harmful conduct. We use a combination of human review and automated systems to keep the Services safe.

§ 02

How ampd is funded

ampd is currently in early access and is free to use for creators, brands and agencies. We reserve the right to introduce fees in the future — including subscription fees, transaction fees, or service charges on campaigns run through the Services.

If we introduce fees that would apply to you, we will give you advance notice and an opportunity to review the new terms before they apply. Continued use of the Services after fees take effect constitutes your acceptance of those fees.

We do not sell user data. We do not show third-party advertising on the Services.

§ 03

Your commitments to ampd and our community

We provide the Services to you. In exchange, you make the following commitments to us and to other users.

Who can use ampd

To use the Services, you must:

  • Be at least 18 years of age.
  • Not be a person prohibited from using the Services under applicable laws.
  • Not have previously had your account suspended or terminated by ampd for breach of these Terms (unless we grant you express permission to return).
  • Not be a competitor of ampd accessing the Services to monitor or replicate our features.

What you can share, and what you can't

You're responsible for everything you post, share, send and upload on ampd. You agree not to use the Services to share content that:

  • Violates these Terms, our community standards, or any applicable law.
  • Infringes anyone else's intellectual property, privacy or publicity rights.
  • Is fraudulent, misleading, deceptive, or part of a scam.
  • Is unlawful, defamatory, threatening, harassing, hateful, or violently extreme.
  • Sexually exploits or endangers children, or contains nudity or sexually explicit material.
  • Is spam, repeated unsolicited messaging, or commercial promotion not authorised by ampd.
  • Contains viruses, malware, or any code designed to disrupt or damage the Services.
  • Impersonates any person or entity, or misrepresents your affiliation with any person or entity.
  • Buys, sells, or trades fake followers, fake engagement, or fake audience data.

You also agree not to:

  • Create more than one ampd account for the same role (creator, brand, or agency), without our permission.
  • Use the Services to harm other users, including by stalking, doxing, threatening or harassing them.
  • Use automated systems (bots, scrapers, crawlers) to access or collect data from the Services without our prior written consent.
  • Reverse-engineer, decompile, or extract the source code of any ampd software or systems.
  • Interfere with the Services' security or attempt to bypass any measures we use to restrict access.
  • Use the Services in any way that would expose ampd or other users to legal or regulatory risk.

The permissions you give us

When you use the Services, you give ampd certain permissions.

Permission to display your profile and content on the Services

You give us a non-exclusive, royalty-free, transferable licence to host, store, display, distribute, and use the profile information, social media data, sample work, campaign content, and other materials you share on the Services, solely for the purpose of operating and improving the Services. This licence ends when you delete the relevant content or your account, except where (a) we are legally required to retain the content, (b) the content has been shared with other users who have not deleted it, or (c) the content is reasonably needed for fraud prevention, dispute resolution, or backup integrity.

Permission to access your connected social accounts

When you authorise ampd to connect to your Instagram, YouTube, TikTok, Facebook, X, LinkedIn or other social media account, you give us permission to access the data described in our Privacy Policy through that platform's official API. You can revoke this permission at any time.

Permission to use your feedback

If you give us feedback, suggestions, or ideas about the Services, you agree we can use them without any obligation to you.

Your account and your responsibility

You are responsible for your ampd account. This means: keeping your login credentials safe and not sharing them; providing accurate information when you sign up and keeping that information up to date; promptly notifying us at support@ampd.world if you suspect unauthorised access to your account; and being accountable for activity that happens on your account, even if someone else is using it (unless you can show the access was unauthorised and you reported it promptly).

Campaigns, payments and disputes between users

When creators and brands (or agencies) run campaigns through ampd, the campaign terms — deliverables, deadlines, fees, content ownership, usage rights — are agreed between the users involved through the Services. Creators retain ownership of the content they create. Brands receive a licence to use that content as agreed in the campaign brief. ampd does not claim ownership of campaign content. ampd may facilitate payments via regulated payment partners. Where escrow applies, funds are released when both parties confirm delivery in accordance with the campaign terms. If a dispute arises between users about deliverables, quality, or payment, the users should attempt to resolve it directly through the Services. ampd is not a party to user agreements and does not arbitrate disputes between users, but we may suspend payments, withhold funds, or take other action where necessary to protect the integrity of the Services.

Content created on or for ampd's promotion

If you submit or publish content on ampd that ampd itself features (for example, on our blog, social channels, or marketing materials), you give us permission to use that content for promotional purposes, with attribution where reasonable. We will obtain your express consent before using any private or sensitive content for promotion.

§ 04

Additional provisions

Updating these Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on ampd.world, update the effective date at the top, and, where appropriate, notify you through the Services or by email. The updated Terms take effect on the date specified. If you do not agree to the updated Terms, you must stop using the Services and may delete your account. Continued use of the Services after the updated Terms take effect constitutes your acceptance.

Account suspension or termination

We may suspend or terminate your account, or restrict your access to all or part of the Services, at any time and without prior notice if: you materially or repeatedly breach these Terms or any of our policies; you engage in conduct that creates legal, regulatory, financial, or reputational risk to ampd; you infringe other users' intellectual property rights; we are required to do so by law; or we discontinue the Services in whole or in part. You may stop using the Services and close your account at any time by contacting us at support@ampd.world. Closure of your account is governed by the data retention practices described in our Privacy Policy. Sections that by their nature should survive termination — including the licences you've granted us, your indemnification obligations, limitations of liability, and dispute resolution provisions — will survive after your account is closed.

Limits on liability

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, ampd disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Services will be uninterrupted, error-free, secure, or that defects will be corrected. To the maximum extent permitted by applicable law, in no event will Xilligence, its directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of or inability to use the Services. Our total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the Services will not exceed INR 1,000 or the amount you have paid us in the past twelve months, whichever is greater. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. If you are in such a jurisdiction, some of the above may not apply to you, and you may have additional rights.

Indemnification

You agree to indemnify, defend, and hold harmless Xilligence and its officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Services, (b) your breach of these Terms, (c) your violation of any third-party rights, including intellectual property or privacy rights, or (d) any content you share on the Services.

Disputes

These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms or your use of the Services will be subject to the exclusive jurisdiction of the courts of Thiruvananthapuram, Kerala, India. Before initiating any formal legal action, you agree to first contact us at support@ampd.world and attempt to resolve the dispute informally. Most disputes can be resolved this way.

Other

Entire agreement. These Terms, along with our Privacy Policy and any other policies we publish, make up the entire agreement between you and ampd regarding the Services. No waiver — if we don't enforce a provision of these Terms in a particular case, that doesn't mean we waive the right to enforce it in the future. Severability — if any part of these Terms is found unenforceable, the rest will remain in full effect. Assignment — you may not transfer your rights or obligations under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law. No third-party beneficiaries — these Terms don't create any rights for any third party.
